These Terms and Conditions (the “Terms”) govern the FasTab Referral Program (the “Program”), administered in Canada by FasTab Payments Inc. (“FasTab”). By participating in the Program you agree to be bound by these Terms and by the FasTab Privacy Policy. FasTab may amend, suspend, or terminate the Program at any time, for any reason, without notice.

Territory. The Program is open to referrals of businesses located in Canada only. Referrals of businesses located outside Canada are not eligible.

1. Who can participate

Any individual aged 18 or older who is a resident of Canada may participate as a “Referrer,” including FasTab customers, FasTab employees, consultants, partners, and members of the public. Referrers must submit referrals through the online referral form or in writing to a FasTab representative.

The following are not eligible to participate:

  • Members of the FasTab sales organization, and their immediate family and household members.
  • Employees of authorized FasTab resellers, agents, or referral partners operating under a separate commission or revenue-share agreement, and their immediate family and household members.
  • Owners, operators, or decision-makers referring a business they own or for which they make the payments purchasing decision.
  • Franchisors referring their own franchisees where the franchisor makes the purchasing decision.
  • Individuals under 18 years of age, and individuals residing outside Canada.

2. What counts as a qualified referral

A “Qualified Referral” is a business that:

  • is referred to FasTab by the Referrer through the online referral form or in writing to a FasTab representative;
  • is located in Canada;
  • is not already a FasTab customer and is not an existing lead in FasTab’s systems;
  • has consented to its business contact details being shared with FasTab for the purpose of being contacted about FasTab products and services; and
  • enters into a merchant agreement with FasTab and begins processing payments.

Verbal referrals are not accepted. A business group, corporate entity, or franchise group affiliated with an existing FasTab customer or a previous Qualified Referral will not be treated as a new Qualified Referral. FasTab determines the original lead source and whether a referral qualifies, in its sole discretion. Exceptions may be made at FasTab’s discretion where the business has not been contacted by FasTab for at least six (6) months.

3. Rewards

Reward amounts are variable. A Referrer may earn up to CA$1,000 per Qualified Referral (the “Reward”). The amount awarded for any given Qualified Referral is determined by FasTab in its sole discretion based on factors including the products the referred business goes live with, the number of locations and devices deployed, and expected processing volume.

· Timing

Rewards are issued monthly, after the referred business has been live and processing payments for at least thirty (30) days.

· Form

Rewards are paid by electronic funds transfer, prepaid card, or virtual card, as selected by FasTab. FasTab employees receive Rewards through internal payroll or recognition programs.

· Groups

For a multi-location business group, the first location that is a Qualified Referral is eligible for the full Reward; locations two through ten are eligible for up to 50% of the Reward each; no Reward applies from the eleventh location onward.

Prepaid and virtual cards may be subject to the additional terms and restrictions of their third-party issuer. The Referrer is responsible for contacting the issuer directly about redemption. FasTab is not responsible for a card that is lost, stolen, destroyed, or used without permission, and lost or stolen cards will not be replaced.

4. General

FasTab determines in its sole discretion whether a referral is a Qualified Referral eligible for a Reward, and reserves the right to disqualify any Referrer from the Program at any time, including where FasTab believes in good faith that the Referrer has breached these Terms or has submitted a referral without the referred business’s consent. Subject to the group limits above, there is no cap on the number of referrals a Referrer may submit while the Program is in effect.

The Referrer is solely responsible for any tax reporting and payment obligations arising from a Reward.

The Program is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, FasTab disclaims all warranties, conditions, and terms of any kind, whether express or implied by statute, common law, or custom, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, FasTab’s maximum aggregate liability arising out of or in connection with the Program, regardless of the cause of action, shall not exceed CA$100.

These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein.

5. Privacy and contacting the business

By submitting a referral you confirm that you have the referred business’s permission to give its contact details to FasTab, and that you are providing those details so that FasTab may contact the business about its products and services.

A referral is not anonymous. FasTab’s first message to a referred business identifies you by name and states that the message is being sent because you referred them — both so the business understands why it is hearing from us, and because Canada’s anti-spam legislation requires it of a message sent on the strength of a referral. If you do not want your name given to the business, do not submit the referral.

· How often we contact them

Unless the business consents to further contact, FasTab sends a single message following a referral. Every commercial electronic message FasTab sends includes an unsubscribe mechanism, and the business may opt out at any time.

· When we will not contact them

FasTab may decline to act on a referral, without it becoming a Qualified Referral, where FasTab cannot contact the business in compliance with applicable anti-spam or privacy law — including where the relationship between you, FasTab, and the business does not support doing so.

· Your information and theirs

Personal information collected through the referral form — yours and the business contact’s — is handled in accordance with the FasTab Privacy Policy. You or the referred business may withdraw consent at any time by writing to sales@fastabpayments.com. Withdrawing consent may end a referral’s eligibility for a Reward.

6. Changes to these Terms

FasTab may modify these Terms or end the Program at any time, in its sole discretion, without notice. The Terms in effect on the date a referral is submitted apply to that referral. Questions about the Program can be sent to sales@fastabpayments.com.
